UCAS student panel terms and conditions

UCAS Media is a wholly owned subsidiary of Universities and Colleges Admissions Service (“UCAS” English company number 02839815).

1.    Acknowledgment and Acceptance

1.1    UCAS Media has set up an online research panel for UCAS and UCAS Media to provide individuals with opportunities to engage in surveys and other research activity.  The Panel is called UCAS Student Panel and is hosted by a third party provider.

1.2    By signing up during the registration process to become a member of the UCAS Student Panel, and by participating in any UCAS Student Panel activities, you agree to comply with these Terms and Conditions (the “Terms”). 

1.3    Please read these Terms carefully before you register. We reserve the right to alter these Terms without prior notice. 

2.    Membership Eligibility and Registration

2.1    You can only join the UCAS Student Panel if you meet the following Criteria:

a)    resident in the United Kingdom;
b)    aged 16 years or over;
c)    not an employee or director of the UCAS Group or a member of their immediate families and household;
d)    not associated with the administration of the UCAS Student Panel or prize draws.

2.2    By signing up to the UCAS Student Panel you agree that you meet the Criteria. We may require you to provide evidence that you meet the Criteria.

2.3    You must use the same email address for registration that you have used to create your UCAS Hub account.

2.4    You agree to disclose true and complete information during the account registration process, and to update your information if and when it changes. 

2.5    When you sign up to the UCAS Student Panel, by ticking a box, you will be confirming that you understand and agree to how your personal information will be used, as explained in these terms and our UCAS Privacy Policy and our Surveys Privacy Notice.

2.6    If we suspect that any provided information is false, outdated, or incomplete, we can suspend or terminate your account.

3. Code of Conduct – Your Obligations

3.1    You can only use the UCAS Student Panel for personal, non-commercial use. 

3.2    You agree not to use spiders, bots, or other automated means to manipulate or influence surveys or other panel activities.

3.3    You cannot create more than one account or transfer your account to anyone else.

3.4    Your account must only be accessed by you.  Where you choose or are provided with a log-in, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. Please ensure that you log off when not using the UCAS Student Panel and ensure that devices which you use to access the UCAS Student Panel are securely locked when not in your possession. 

3.5    You must notify us if you suspect there has been any unauthorised use of your log-in or password or any other breach of security.

3.6    We can suspend or terminate your account if it is subject to unauthorised use.

3.7    You agree that you are responsible for all the responses you provide and that your responses will be complete, accurate and honest.

3.8    You must not: 

a)    provide any responses that are unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, profane, vulgar, obscene, invasive of another person’s privacy, hateful, fraudulent, discriminatory, provokes or encourages violence or is racially, ethnically or otherwise objectionable;
b)    provide any responses that include personal data about others;
c)    engage in any fraudulent activities, such as "speeding" through surveys, selecting the same response repeatedly (straight-lining), completing the same survey multiple times, providing inconsistent answers or selecting incorrect dummy answers.
d)    impersonate any person or entity, or misrepresent your relationship with any person or entity;
e)    harass any other person;
f)    collect or store personal data about other users
g)    decrypt, extract, disassemble, reverse-engineer or decompile the UCAS Student Panel 
h)    include any portion of the UCAS Student Panel in any other software program
i)    develop methods to enable unauthorised parties to use the UCAS Student Panel
j)    create any modifications or derivative works directly or indirectly using the UCAS Student Panel, or components thereof
k)    knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware of the UCAS Student Panel;
l)    damage, interfere with or disrupt the UCAS Student Panel in any way;
m)    use the UCAS Student Panel or information obtained from the UCAS Student Panel to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
n)    use the UCAS Student Panel for any purpose that is unlawful, fraudulent, improper or illegal, or in breach of any, or for the purpose of breaching any, law;
o)    use the UCAS Student Panel in a way which infringes the rights of or harasses anyone else, is harmful to, or otherwise restricts or inhibits anyone else's use and enjoyment of the UCAS Student Panel; 
p)    use the UCAS Student Panel for the purpose of harming or attempting to harm minors in any way.

3.9    You must not attempt to interfere with the proper working of the UCAS Student Panel and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other internet connected device. You are also advised to use the appropriate antivirus software before and during access to the UCAS Student Panel.

3.10    We have the right to suspend or terminate your account if, in our reasonable judgement you have failed to comply with any of the provisions of these Terms.  We will not be liable for any loss or damage whatsoever resulting from the disclosure of log-in or password contrary to these Terms. We may also withhold any rewards (where applicable) if we believe you have breached your obligations.

4. Rewards

4.1    We will give you details of survey and research invitations (assignments) on the surveys section on the your UCAS Student Panel dashboard or via email.  

4.2    Some assignments may be offered in exchange for points that can be collected and later exchanged for vouchers, or we may offer entry in to a prize draw for a chance to win a prize. We will provide you with details of any rewards we may offer when we give you details of the assignment .

4.3    Where activities offer opportunities to collect points, one point is worth one pence.  When your points meet the minimum value of £15 you may be able redeem your points for vouchers.  Points are calculated on a monthly basis and any points below the value of £15 will carry over to the next month. The number of points awarded may vary per activity.

4.3.1   Where we provide you with the opportunity to enter a prize draw for the chance to win a prize, the UCAS prize draw terms and conditions shall apply and any additional or alternative rules will be provided at the time of notification. You will need to review the prize draw rules for each prize draw individually before you decide whether to take part. 

4.4    By agreeing to these Terms you agree that we can share your first name, email address and UCAS account ID with our third party rewards provider.  

4.5    We will only send details of opportunities for rewards to the email address you used to create your UCAS Hub account.

4.6    Any rewards from us are intended to encourage participation and are not given as compensation for time spent. However, any payments received from our activities may be considered taxable income and it is your responsibility to report to HM Revenue & Customs as required.

4.7    If your account remains inactive for twelve (12) months or more, we may reclaim any unclaimed rewards. Your account is inactive if you have not participated in surveys, assignments, discussions, or polls within the last twelve months.

4.8    We can change the types of activities that provide rewards and adjust rewards at any time.  We will give you notice of this where we can.

5. Surveys and Research Tasks

5.1    Survey and research invitations (assignments) will be sent via email or posted on the Surveys Page on your UCAS Student Panel account dashboard.

5.2    Some assignments may be subject to quotas or maximum response limits and are available on a first-come, first-served basis. We will let you know if this is the case when we notify you about the assignment

5.3    You do not have to accept an assignment but this may affect your entitlement to any reward or prize draw entry.

5.4    Where you choose to participate you must complete the activity by the specified deadline. If you do not meet the deadline then your activity will not be accepted and reward or prize draw entry will not be made.

6. Confidentiality and Intellectual Property Rights

6.1    In connection with your use of the UCAS Student Panel and membership of the UCAS Student Panel, you may access confidential and proprietary information. You agree not to disclose, copy, or reproduce any confidential or restricted content.

6.2    We are the owner or licensee of all copyright and other intellectual property rights in any material contained on the UCAS Student Panel.

6.3    You may access the UCAS Student Panel for personal non-commercial use only. The intellectual property rights in the UCAS Student Panel shall be retained by UCAS or, where the material has been licensed to UCAS, by the owners of the rights in the material. 

6.4    The UCAS Student Panel contains trademarks which belong to UCAS or which have been licensed to UCAS by the trademark owners. Any use of these trademarks by you is forbidden. 

6.5    Links to the UCAS Student Panel are not permitted, other than links for your personal use. Links to the UCAS Student Panel from within a frameset definition are not permitted.

6.6    You may not create a database by systematically downloading substantial parts of the UCAS Student Panel.

7. User Content

7.1    You are solely responsible for content or materials you submit, post, or transmit in connection with UCAS Student Panel activities and you warrant that you own the intellectual property rights in the content you submit, post, or transmit.

7.2    By submitting content, you grant us a royalty-free license to use, display, or distribute this content for lawful purposes, including for the marketing or promotional activities of the UCAS Group.

8. Data Protection

8.1    By signing up and agreeing to take part in the UCAS Student Panel you agree that UCAS and UCAS Media can use your personal information for the purpose of administering your participation in the Panel.  Our Privacy Policy and Surveys Privacy Notice explains how we use your data.  This includes:

a.    using other data we hold about you such as your application or information from your Hub account so we can better target you with surveys relevant to you. We will also use this information to apply ‘weighting’ to our results. This is a technique that helps us bring results in line with the population being studied and may include the use of your sensitive data such as your ethnicity; and
b.    sharing your first name, email address and UCAS account ID with our third party  provider so you can access the UCAS Student Panel, log your completed surveys on your personalised dashboard and claim any rewards

8.2    Any survey results we share will be anonymised to ensure that you cannot be identified. Further details on how your data is used and stored, is included in our Privacy Policy  and our Surveys Privacy Notice.  You will also need to review the privacy information for each survey individually for further data processing information before you decide whether to take part.

8.3    You can amend, update or delete your personal information at any time.  If you have any questions or concerns about the personal information held about you by UCAS or UCAS Media, please contact datagovernance@ucas.ac.uk

9. Ending your Membership

9.1    You may withdraw from the UCAS Student Panel at any time by notifying us through the Contact form on the UCAS Student Panel website or via email at panel@ucas.co.uk. Any accumulated points below the Threshold will be forfeited upon termination.

9.2    We reserve the right to suspend or end your membership if you breach any of these Terms. In cases of severe misconduct, we may terminate your membership immediately without any liability to you.

9.3    We reserve the right to end the UCAS Panel at any time, and any unredeemed earnings will be non-redeemable. We will make reasonable efforts to notify you before we end the UCAS Panel.

10. Disclaimers and Limitations of Liability

10.1    The UCAS Student Panel and the UCAS Student Panel website are provided "as is," and we make no representations or warranties regarding availability, functionality or that the information and content we provide is accurate, complete or up to date.  

10.2    We cannot guarantee that access to the UCAS Student Panel or to Panel activities will be uninterrupted or error-free. UCAS Media is not responsible for delays or errors in data caused by transmission of that data via the internet or third party platforms.

10.3    Insofar as is permitted by law, UCAS, UCAS Media, its agents or distributors will not in any circumstances be responsible or liable to compensate you or accept any liability for any loss, damage, personal injury or death occurring as a result of participating in the Panel except where it is caused by the negligence of UCAS, UCAS Media, its agents or distributors or that of their employees. Your statutory rights are not affected.

11. Indemnification

11.1. You agree to indemnify and hold UCAS and UCAS Media harmless from any claims, liabilities, or expenses arising from your use of the UCAS Student Panel and UCAS Student Panel website.

12. Changes to the Terms

12.1. We reserve the right to make changes to these Terms at any time. Continued use of the UCAS Panel after changes have been posted constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

13.1. These Terms shall be governed by and construed in accordance with the laws of the England and Wales and any claims or disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

14.1. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in effect.

15. Miscellaneous

15.1. These Terms represent the entire agreement between you and UCAS with respect to the UCAS Panel. Any failure by UCAS to enforce any provision does not constitute a waiver of that provision.

16. Third party rights

16.1    The Universities and Colleges Admissions Service (English company number 02839815) shall be entitled to enforce the terms of this agreement pursuant to the Contracts (Rights of Third Parties) Act 1999. Except for UCAS, a person who is not a party to this agreement shall not have any rights to enforce any term of this agreement.
