Consumer protection – impact of the changes in Confirmation & Clearing

  • Confirmation: applicants whose conditional offers are confirmed do not have a 14 day ‘cooling off’ period. It is therefore, at your discretion whether or not you agree to release an applicant into Clearing if asked to do so.

  • Changes at Confirmation – 14 day ‘cooling off’ period: if you make a changed course offer, a changed year of entry offer, or a changed point of entry offer at Confirmation, this is a material variation to the terms of the offer. If an applicant accepts the changed offer, they have 14 days to change their mind after accepting it. They may contact you to request a release into Clearing or a withdrawal as a result of this.
  • Clearing – provision of pre-contract information to applicants: you should provide applicants with material information about a course, including its structure and fees, and their terms and conditions, before they make a decision on a Clearing or Adjustment offer.
  • Clearing – 14 day ‘cooling off’ period: applicants have the right to change their minds about offers accepted during Clearing up to 14 days after accepting them. They may contact you to request a release into Clearing or a withdrawal as a result of this.
  • Adjustment – 14 day ‘cooling off’ period: as with Clearing acceptances, applicants placed through Adjustment have the right to change their mind up to 14 days after the decision has been processed. However, they are not entitled to go back to their original unconditional firm (UF) place as a result of this – they can only be released into Clearing or withdrawn.

If a confirmed applicant contacts you to request that you cancel their place, please clarify if they want to completely withdraw from the UCAS Undergraduate scheme for this year, or if they mean they want to be released into Clearing. Please then update your systems using the appropriate procedure.

In giving information and advice to applicants during Confirmation and Clearing, we will play our part in ensuring applicants understand and can exercise their consumer rights. Any information and advice we provide to applicants who may wish to change their application or be released into Clearing, will be given on the basis of the information held in our systems.
